ISLAMABAD: A petition challenging the procedure of appointment of National Accountability Bureau (NAB) chairman was filed in the Supreme Court on Tuesday.
The petition was filed by GM ChaudhryAdvocate under Article 184 (3) of the constitution, making the president of Pakistan, prime minister as leader of the house in National Assembly, leader of the opposition in National Assembly, secretary ministry of law and justice, NAB chairman and deputy chairman as respondents.
The petition pleaded the court to restrain the president from making appointment of the NAB chairman on the collusive recommendations of the prime minister and the opposition leader, besides restraining the NAB chairman and deputy chairman from performance of their functions under the provisions of the National Accountability Ordinance, 1999, by authorising any senior officer of the NAB to perform necessary functions for the time being in the interest of justice and until new appointment of the chairman and deputy chairman of NAB are made.
He stated that the procedure of appointment of the NAB chairman provided in Section 6(b) of the Ordinance of 1999 was amended by Section 7 of the NAB (Amendment) Ordinance, 2002 (Ordinance No. CXXXIII of 2002), with retrospective effect, which was unconstitutional.
The petitioner said the amended ordinance promulgated by the president on November 15, 2002, was actually made and promulgated on November 23, 2002. He also prayed the court to declare all the appointments made to the office of the NAB chairman since the year 2002 illegal.
